“Educator” - Foot Care Nurse Educator, or a college, university, or a health agency with a license to use and access Foot Canada Training’s “Curriculum Program”.
“Team Member” - an employee or contractor working for the Educator.
NOTICE TO TEAM MEMBER:
An Educator with a license to access and use Foot Canada Training's Onsite Foot Care Clinical Course, Onsite Foot Care Nurse Clinical Refresher Course and Advanced Foot Care Nurse Skills Workshop Curriculum has provided you access to the curriculum under their licensing agreement with Foot Canada Training.
In accessing Foot Canada Training's curriculum you, the Team Member, are bound by the terms of the Educator's signed Foot Care Nurse Curriculum Agreement with Foot Canada Training, a few sections of which are included below for ease of reference.
1.0 LICENSE TO ACCESS & USE
1.1. Provided the Educator meets Foot Canada Training's criteria listed in the Recital and has paid the “FCN Curriculum Fee” in Article 2.0, the Educator will be granted the right to access the “Educator’s Corner” on the FCTI website, where the Educator will have access to all available FCTI tools, forms, templates, customized curricula and other training resources to run the following quality foot care nurse training programs: Onsite FCN (Clinical), being the mentorship and clinical component of the FCN course; the Clinical Refresher course; and Advanced Skills Workshop series (“FCN Curriculum Program”), for use by Educator in teaching foot care nursing to his, her or its students and participants (“Purpose”).
1.2. The right granted herein to access the “Educator’s Corner” and to use the “FCN Curriculum Program” is a restricted, non-exclusive, revocable license to access and use the materials therein exclusively for the Purpose set out in Section 1.1, without the right to sublicense, copy, publish or to otherwise use any of the materials therein, whether in whole or in part, for any purpose other than for the Purpose in Section 1.1 hereof.
1.5. Any unauthorized use by the Educator of the “FCN Curriculum Program”, or any un-authorized access to the “Educator’s Corner” or to the “FCN Curriculum Program”, or to any part thereof, by persons gaining access through Educator’s access code or password, may result in the immediate termination of this License by FCTI, at FCTI’s sole and absolute discretion.
4.1. All rights, title and interest in and to, and legal ownership of, the “FCN Curriculum Program” (including all available tools, forms, templates, customized curricula and other training resources embedded in the following modules: the Onsite FCN (Clinical) Course, FCN Clinical Refresher Course, and Advanced Skills Workshops), including all copyright and other intellectual property rights therein, are and shall remain the intellectual property of FCTI.
4.2. The Educator will acquire no rights, title or interest in or to the “FCN Curriculum Program”, or in or to any part thereof, other than the right to use the components, modules and other materials therein for the limited Purpose set out in Section 1.1. While the Educator may modify components of the different courses or modules to better reflect his, her or its requirements, the underlying content is and shall remain the intellectual property of FCTI. The Educator may not publish, share, transfer, sell, assign or sublicense any of the “FCN Curriculum Program” components, modules or other materials, either alone or embedded as part of any modified program, course or publication, without the express written consent of FCTI.
Please note that access to the Educator’s Corner does NOT grant a sublicense to the curriculum. You can only access the curriculum as a representative of the Educator, and cannot use or claim rights to use and teach the curriculum independently from their organization.
Also note that to protect Foot Canada Training's ownership and copyright Foot Canada Training's documents should NOT be emailed, other than the administrative/registration documents documents listed below, which can be emailed to students as needed:
